Medical Journal: IMJ Health- Patent Consent Policy

IMJ Health- Patent Consent Policy

We trust our authors to adhere to these guidelines and to respect the rights of individuals and patent holders involved in their research.

Medical Journal IMJ Health is committed to maintaining the highest standards of ethical publishing, particularly when it comes to the inclusion of personal information, images, or intellectual property such as patents. This policy outlines the requirements for obtaining consent and permissions when such content is included in submissions to the journal.

Requirements for Consent:

1. Obtaining Consent for Personal Information and Images:

  • Authors must obtain appropriate consents, permissions, and releases when including case details, personal information, or images of patients and other individuals in their submissions.
  • It is the author’s responsibility to ensure that any individual (or their legal guardian) who is identifiable in any video, photograph, image, illustration, or case report is fully informed of the intended use of such content. Written consent must be obtained from the individual or their legal representative.
  • If consent is given under specific conditions (e.g., ensuring anonymity), the author must inform Medical Journal IMJ Health in writing about these conditions. Copies of the written consent must be retained by the author and provided to the journal upon request.

2. Respectful Portrayal:

  • Even when consent is obtained, the portrayal and description of the individual must be respectful. The content should not, in any way, demean or misrepresent the individual involved.

3. Alteration for Anonymity:

  • If identifying details are altered to protect anonymity, the author must ensure that these changes do not distort the scientific integrity or meaning of the content.

4. Corporate Use:

Patent Content Use:

1. Patent Rights:

  • A patent is a legal right that allows its holder to exclude others from making, using, or selling an invention for a specified period. Authors using content related to patents must obtain permission from the patent holder before including such content in their submissions to the journal.
  • Medical Journal IMJ Health expects that authors have taken all necessary steps to obtain the required permissions from patent holders. If any concerns arise about the use of patent-protected content, the journal reserves the right to disqualify such material from publication.

2. Legal Compliance:

  • Responsibility of the Author:
    • It is the author's duty to ensure that all necessary consents and permissions are obtained in compliance with relevant laws and regulations regarding privacy, security, and intellectual property.
    • Failure to comply with these requirements may result in the rejection or retraction of the submitted material.

Medical Journal IMJ Health is dedicated to upholding the integrity and ethical standards of the academic publishing process. We trust our authors to adhere to these guidelines and to respect the rights of individuals and patent holders involved in their research.
